1. Service provider

2. Description of the service

Kobem is software for real estate companies that answers calls, qualifies contacts and provides a dashboard with your business information. The service is provided “as is” and may evolve over time.

3. Registration and account

You must provide accurate information and keep your credentials confidential. You are responsible for the activity on your account. You must be of legal age and use Kobem in the course of a professional activity.

4. Plans, prices and payment

The applicable plans and prices are shown on the website. Unless otherwise stated, prices do not include taxes. Billing is recurring (monthly or annual) and renews automatically unless cancelled. Usage above your plan may incur overage charges according to the plan you have contracted.

5. Acceptable use

You may not use Kobem to:

• Engage in unlawful purposes or infringe the rights of third parties.
• Make non-consented calls or spam.
• Attempt to access, alter or overload the service.
• Resell the service without authorization.

You are responsible for complying with the regulations applicable to your activity, including informing and obtaining the consent of the people whose calls are recorded.

6. Intellectual property

Kobem, its brand, software and interface are owned by the service provider. We grant you a limited, non-exclusive and non-transferable license to use it for the duration of your subscription. Your data remains yours.

7. Data protection

The processing of personal data is governed by our Privacy Policy. With respect to the data of the customers who call, Kobem acts as data processor on your behalf.

8. Liability

We work to provide a reliable service, but we do not guarantee uninterrupted availability or that it will be error-free. To the extent permitted by law, our liability is limited to the amount paid for the service in the 12 months prior to the event giving rise to the claim. Nothing in these Terms excludes liabilities that cannot be limited by law.

9. Term and cancellation

You may cancel at any time from your account or by writing to us. Cancellation takes effect at the end of the period already paid for. We may suspend or terminate your access if you breach these Terms.

10. Modifications

We may modify these Terms. We will publish the current version on this page and, if the change is significant, we will notify you with reasonable advance notice.

11. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of Madrid, unless consumer regulations establish another venue.
