Terms of Service
Last updated: 4 November 2026
These Terms govern access to and use of Kobem. They are a contract between KOBEM TECHNOLOGIES - FZCO (“Kobem”, “we”) and the company or professional that signs up (“you”). If you sign up on behalf of a company, you confirm that you can bind it. If you do not agree with these Terms, do not use Kobem.
1. Service provider
Provider: KOBEM TECHNOLOGIES - FZCO, with registration No. 85517 and trade licence No. 92297, issued by the Dubai Integrated Economic Zones Authority (DIEZA), registered address at IFZA Properties, Premises DSO-IFZA, Dubai Silicon Oasis, Dubai, United Arab Emirates. Contact: contact@kobem.ai.
2. Definitions
- Service: the Kobem software, including call handling, the dashboard, the integrations and their updates.
- Customer Data: what you or the people who call you put into the Service, such as properties, criteria, recordings and transcripts, and what is generated from it.
- Caller: anyone who calls a number you have connected to Kobem.
- Proposal: a document signed by both parties with specific conditions. If it says something different from these Terms, the Proposal prevails on that point.
3. The Service
Kobem is customer engagement and qualification software for real estate. It handles inbound calls, qualifies each client on your properties and criteria, and turns each conversation into data in your dashboard. The Service evolves: we may add, change or withdraw features. If a change substantially reduces what you pay for, we tell you in advance and you can cancel. What a custom plan includes is what your Proposal states, and features announced as coming soon are not part of the Service until they are available. The integrations available in your account are those shown in your dashboard or your Proposal: the website mentioning a tool does not mean it is available for your account.
4. Registration and account
You must provide accurate information and keep your credentials confidential. You are responsible for the activity on your account and must tell us as soon as you detect unauthorised access. You must be of legal age and use Kobem as part of a professional activity. Kobem is for businesses and professionals only: by signing up you confirm you are not a consumer.
5. Plans, prices and payment
- The applicable price is the one in your Proposal or, if there is none, the one we confirm to you in writing before the first charge. Unless stated otherwise, it does not include taxes.
- Billing is periodic, according to your plan or Proposal, and renews automatically unless cancelled. Depending on the plan, minutes are billed separately, as part of the software price, and usage above the plan may carry additional charges.
- What your phone operator charges you for forwarding calls to Kobem is not included.
- Numbers assigned by Kobem cannot be transferred and are reclaimed when the Service ends.
- Price changes apply from the next renewal, with reasonable notice.
- If a payment fails or is late, we may suspend the Service after notifying you.
- Amounts already paid are not refundable, unless the law provides otherwise.
- Free trials and demos last as long as stated when they are offered and come with no commitment as to results. In demos with sample data, the properties, prices and answers are illustrative. If a demo uses your data or handles your clients’ calls, these Terms and the Data Processing Addendum apply. When they end, access may stop and their data may be deleted.
6. Acceptable use
Use of Kobem is subject to the Acceptable Use Policy. In particular, you may not use Kobem to:
- pursue unlawful purposes or infringe the rights of others;
- make unsolicited calls or spam: Kobem is made for inbound calls;
- try to access the Service without permission, alter it, overload it or reverse engineer it;
- resell it without authorisation, or use it to build or train a competing product.
7. Your calls and your obligations
You are responsible for complying with the rules that apply to your business and your calls. In particular:
- for informing Callers and obtaining any consent required, including for recording, and for saying that an automated system is answering where the law requires it; the notice Kobem includes by default does not relieve you of this;
- for having the right to use the numbers, properties and content you load;
- for the accuracy of properties, prices and criteria, because Kobem relies on them to answer;
- for complying with the rules of your sector, such as real estate licensing and advertising.
8. Automatically generated content
Kobem automatically generates replies, transcripts, summaries and qualifications, and they may contain errors or omissions. They are not legal, financial, tax or valuation advice, and your team must check them before relying on them for an important decision. The decisions you take based on them are your responsibility. Kobem answers on your behalf: what it tells a Caller, such as a price or availability, does not bind Kobem, and you are the one answerable to that person.
9. Customer Data and data protection
Customer Data remains yours. You authorise us to host, process and transmit it as needed to provide, maintain and fix the Service, including through our sub-processors.
For the personal data of Callers, Kobem acts as a processor on your behalf under the Data Processing Addendum, which forms part of these Terms.
What Kobem handles for its own purposes is governed by the Privacy Policy.
Neither Kobem nor its artificial-intelligence providers use the content of your conversations to train models. Kobem may use technical metrics and aggregated statistics about the use of the Service, which identify neither you nor any person and do not include the content of conversations.
10. Third-party services
The Service depends on telephony operators and other third parties, and can connect with tools you choose, such as your CRM, calendar or messaging. Those tools are governed by their own terms, and Kobem is not responsible for their availability or for how they handle the data you send them.
11. Intellectual property
Kobem, its brand, software and interface belong to the service provider. We grant you a limited, non-exclusive and non-transferable licence to use them while your subscription lasts. If you give us ideas or comments about the Service, we may use them freely and without obligation.
12. Confidentiality
Each party keeps confidential the non-public information it receives from the other and uses it only to perform this contract. This does not apply to what is already public or known, or to what the law requires to be disclosed. This obligation continues after the contract ends.
13. Availability and support
We work to offer a reliable service, but we do not guarantee uninterrupted availability or that it is free of errors. The Service may stop because of maintenance or failures of operators and other third parties. No service levels apply unless a Proposal sets them. Support is provided from the dashboard and at support@kobem.ai, with no guaranteed response times.
14. Warranties
To the extent permitted by law, the Service is provided “as is” and “as available”. Kobem does not guarantee any specific commercial result, such as a number of leads, appointments or sales.
15. Liability
To the extent permitted by law, neither party is liable for indirect or consequential damages, for loss of profits, sales or opportunities, or for reputational harm. This does not limit your payment obligations or clause 16.
In addition, Kobem’s total liability is limited to the amount paid for the service in the 12 months prior to the event giving rise to the claim. Nothing in these Terms excludes liabilities that cannot be limited by law.
16. Indemnity
You will hold Kobem harmless from third-party claims arising from Customer Data, from your failure to inform Callers or obtain their consent, or from your breach of these Terms or the Acceptable Use Policy. Kobem will tell you about the claim without delay.
17. Term, suspension and cancellation
- The contract lasts while your subscription is active. You can cancel at any time by writing to us at contact@kobem.ai, and the cancellation takes effect at the end of the period already paid.
- We may suspend or cancel your access if you breach these Terms, if you do not pay or if your use poses a security or legal risk. Where reasonable, we will notify you first. Kobem may stop providing the Service on thirty days' notice.
- On termination, you have thirty days to export your data: calls and leads from the dashboard, and transcripts and recordings on request. After that we delete it, including recordings and transcripts, except for what we must keep by law.
- Clauses that by their nature should survive, such as confidentiality, liability, indemnity and governing law, remain in force.
18. Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, such as outages of operators, cloud providers or the power grid, or decisions of an authority. This does not apply to payment obligations.
19. Assignment
You may not assign this contract without our written consent. Kobem may assign it to a group company or as part of a merger, acquisition or sale of assets.
20. Notices
We send notices to the email on your account. You can write to us at contact@kobem.ai.
21. Changes
We may change these Terms. We publish the current version on this page and, if the change is significant, we give you reasonable notice. If you keep using Kobem when it takes effect, you accept the new version; if you do not agree, you can cancel.
22. General
These Terms, with the Data Processing Addendum, the Acceptable Use Policy and any Proposal, are the entire agreement between the parties. If a clause is invalid, the rest remains in force. Not exercising a right does not waive it. English is the binding version of the legal documents; any translation, including of the website, is a courtesy.
23. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates and the parties submit to the courts of Dubai. If you contract as a consumer or reside in the European Union, this clause does not deprive you of the protection afforded by the mandatory rules of your country of residence, nor of your right to bring proceedings before the courts of that country.
